ORDINANCE NO. 241

AN ORDINANCE PROHIBITING THE SALE OR USE OF FIREWORKS WITHIN THE CITY OF GREENWOOD, ARKANSAS, AND FOR OTHER PURPOSES

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GREENWOOD, ARKANSAS

SECTION 1:  It shall hereafter be unlawful for any person to offer for sale, expose for sale, sell at retail or use or explode any fireworks; provided, the Fire Chief may issue a public display permit to any group of three or more adult individuals applying therefore.  Every such display shall be of such a character and so located, discharged or fired as not to be hazardous to property or endanger any person or persons.  Application for a public display permit shall be filed with the Fire Chief at least 15 days in advance of the date of the display and shall state the name and address of the applicants, and the date, time and place of the proposed display.  The Fire Chief shall take action on such application within 48 hours after receipt thereof.  After a public display permit has been granted, use of fireworks shall be lawful only for the purpose stated in the permit.  No permit shall be transferable.

SECTION 2:  That all ordinances, or parts of ordinances in conflict with this ordinance are hereby repealed.

SECTION 3:  Any person found guilty of violating this ordinance shall be subject to a fine of not less than $10.00 nor more than $50.00.

It being found by the City Council of the City of Greenwood that fireworks being exploded in the city limits of the City of Greenwood that create a substantial hazard to the health and welfare of the persons and property of the City of Greenwood and that an emergency exists and that this ordinance shall be in full force and effect from and after its passage and publication.
